Back in court AGAIN, Halle Berry's pit bull lawyer is trying to convince the judge that Gabriel's schedule remains free enough to visit his daughter in France = Halle Berry should get the green light to uproot the young girl from the U.S. to France permanently! 

Reports:

Gabriel Aubry is being grilled today under oath by Halle Berry's lawyer -- and we're told the end game for Halle is for Gabriel to admit he has plenty of free time to travel back and forth to France to visit Nahla.

But here's the deal -- as we first reported, Halle wants to move to Paris with Nahla and fiance Olivier Martinez. Sources tell us Halle's lawyer will ask Gabriel about his work commitments. We're told he works very sporadically as a model and Halle believes he can still maintain a meaningful, long-distance relationship with Nahla as a result.

Gabriel, rightfully so, is completely against Halle moving Nahla to France to live as a "family" with Oliver.

Halle's lawyer is also trying to use Gabe's prior nanny-gate (click Pink for more) and his request for child support/lawyer fees (click Pink for more) from Halle as leverage on why the judge should allow the permanent move in favor of their client Halle.
